IT'S OFFICIAL: The mask ban in Nassau County, NY is now law and takes effect immediately.

It gives police the power to fine people wearing a mask $1,000 and sentence them to jail time.

While the bill includes health and religious exceptions, the broad language means anyone wearing a mask could be arrested.

If you are in Nassau County, please keep wearing mask!

The mask ban bill includes a health exception, so you have the right to assert that you are wearing a mask for health reasons.

But the bill gives cops power to intimidate people wearing a mask, so please be careful.

It's important to know your rights! Even though a mask ban is now law in Nassau County, NY, cops can't:

❌Make you provide a doctors note proving your disability
❌Force you to disclose private health info
❌Make you take off a religious face covering

The Nassau County mask ban applies to all public spaces, not just protests. And the language means that police officers — who are not medical or religious experts — will arbitrarily determine who has the right to wear a mask and who goes to jail.

With the mask ban now law in Nassau County, it's critical to document any wrongful arrests and harassment.

The ban will increase racial profiling by police, and general attacks on all people who are wearing masks.

Documentation will strengthen legal challenges against the ban.

@luckytran I think it would be best if a lawyer would chime in on this and how to properly respond to a police officer seeking to harass you, to include how to challenge a ticket or arrest.

@luckytran

I ride the LIRR through Nassau county on my commute - does the new ban affect me?

@luckytran An EXTREMELY important detail that is on the NYCLU web page briefing about this is that there is a very broad medical exemption, but it is ONLY for people PROTECTING THEMSELVES.

The NYCLU explicitly points out that if you are wearing a mask because you are infected and contagious and are trying to protect OTHERS, that is NOT given an exemption under this law.

They likewise point out that if you are wearing a mask because you live with someone immunocompromised and are trying to protect THEM, that is also NOT given an exemption under this law.

IMPORTANT: If you are wearing a mask in Nassau County and accosted by the police, tell them you are protecting YOURSELF.

(Which, if it's not true, it should be. The first step in not spreading it is not catching it.)

@luckytran Aw, we killed the server with our love and attention.

@luckytran
I remember when NYC & Long Island were bastions of intelligence.

@luckytran I hope that's appealed. Absolute stupidity.

@luckytran I had lunch at a little place in Kanagawa two days ago, and when the master said to me at the buffet, "You don't have to wear a mask!", I responded, "But is it *permitted* to wear a mask?" Then I explained this American shitshow situation, to the amazement of master and his staff.

So I guess the good news is that we've finally found a thing where American Exceptionalism isn't a lie.

And the bad news ...

@luckytran

So, basically law enforcement is saying “we have invested heavily in surveillance cameras that are easily thwarted by people wearing face masks. Wearing a mask is therefore prohibited, unless it’s Halloween. How else could we convict protestors?”

@airwhale @luckytran Yes that would be my take too ,masks do matter for preventing covid etc ,but this is much more wide ranging the clear target is protestors

@luckytran
People need to sue...
This is a matter of public health.

@luckytran unfortunately, politely declining to give PII to a cop will probably end with some broken bones. Plus, this law will absolutely be selectively and unjustly enforced. Yikes.

@luckytran I went into my drugstore today to pick up a prescription. Of course I was wearing a mask, but I was rather happily surprised to see they had masks, hand sanitizer, and stuff out. So I commented on how they must be aware that Covid still exists. The pharmacist said yeah a lot of people right now have Covid. I commented from what I understand one in every three. #WearAMask😷

@luckytran
While I am no lawyer, I'm pretty sure it is a crime to lie to the police in the course of their work. I'm also sure that a lawyer would tell you not to talk to the cops, ever, for any reason.

If you wish to protest by wearing a mask, be prepared to be arrested and face a fine or incarceration. Hire a lawyer and fight in the courts.

@bruce @luckytran
Some sort of card from the #ACLU or a medical professional organization, to hand to police officers, saying you have nothing else to say, and you would like to speak to your lawyer, might be good to distribute to people who are going to challenge this
#MaskBan #Covid

@luckytran
They can't legally ask you what your health reasons or issues are - that is protected. But if someone doesn't feel comfortable asserting their right to privacy, they can say they have asthma, allergies, an autoimmune condition, just getting over a cold... nobody can make you take a mask off! Get name & badge #. Call ABC's Seven on Your Side, or other news advocate - they can be very effective.

@luckytran would get a doctors letter stating such ...

@luckytran I’m in Oregon and have an eye appointment tomorrow. Kaiser sent me an email requesting that I wear a mask.

@luckytran Is there something the New York State government can do to stop this? And if so, do they have the political will/strength to do it?

@luckytran is this freedom? I say it's not. How can wearing a "medical protective device" be illegal?

Won't stand a single fucking lawsuit, but what a waste of time and money these "small government" hypocrites cause! 🙄

@luckytran This is serious Death Cult insanity, but I have to ask: what happens on Halloween?

@luckytran @docpop What are they going to do about scarfs in the winter? That is such broad language. This is so wild.

@luckytran
"This is not an abridgment of anybody’s rights. Nobody has a constitutional right to hide their identity in public."

No, that's not the take. Nobody (especially cops) has a constitutional right to know the identity of everyone around them in public.

@luckytran 5000 people died from Covid in Nassau County.

@luckytran what about them freedums the right are always talking about? Good for me but not for thee.

@luckytran This is ludicrous <cough, cough> COVID, immune compromised! 😳 Fucking idiots…

@luckytran
Pro-disease is an unorthodox stance.

@luckytran Wow - thank you for sharing. This is rather shocking.

@luckytran this is very stupid, every official in this county that helped this become a thing needs to be deported

@luckytran "like" in the sense of "thank you for sharing the info" and not "like the news itself"

@luckytran How is this not being heavily challenged on the basis of free speech? Covid has already been made political. Masking is political speech in support of public health and well being.

@luckytran land of the free, home of the ....

@luckytran This fascist. I will wear a mask if I want to do so.

@luckytran
Insane. This is an indivuals choice which doesn't effect or harm anyone or anything around them.
Ridiculous stripping of another freedom.

@luckytran I understand it's been 100+ years since Nassau introduced Typhoid Mary to the world, but this just seems like a cynical attempt to cash-in on old hits. Back in the day, they used to spread diseases organically, but now some places are trying to juice the numbers

@luckytran

Sigh!
Stupid is as stupid does ...

@luckytran The party of freedom and small government strike again.

@luckytran What on earth is this? I wear them to protect my lungs from allergens in Spring/Summer, then from cold air in fall/winter. Sue me.

@luckytran If Nassau County wanted to make sure I and some others never go there, they’ve just done it. In my case, small loss, but they will lose some immunocompromised, smart, and careful people who will not shop or vacation or visit there. Seems really dumb.

@luckytran
"It gives police the power to fine people wearing a mask $1,000 and sentence them to jail time."

This terrible law gives the police the power to ARREST people wearing masks; whether someone they arrest would actually be charged, fined, and sentenced would be determined through ensuing court proceedings.

@luckytran WTF! Everyone should wear a mask, and let’s see how they handle that!

@luckytran i'm from Albany NY and i do not think this will stand the test of time. who are these people

@oscelot Yup, I've been watching as the bill progressed.

@Texan_Reverend I should have known hehe. So ungodly frustrating x.x I literally had a nightmare about a cop ripping off my mask and breathing on me the other night.
