Die macht unmissverständlich klar, dass die Veröffentlichung der BfV-Erkenntnisse geeignet, erforderlich und verhältnismäßig ist, um die Öffentlichkeit vor der AfD zu warnen und so die Verfassung vor ihren Feinden zu schützen. Mit anderen Worten: Das Zurückhalten des Gutachtens war gesetzwidrig. Rechtfertigung genug für Verstoß gegen Geheimhaltungspflicht?

Nun haben Medien das eigentlich geheime Gutachten veröffentlicht. finkQueerfeindlichkeit scheint im aktuellen Verfassungsschutz-Gutachten zur AfD nahezu gar keine Rolle zu spielen. Das Gutachten stellt die Negierung der Menschenwürde durch diese Partei ins Zentrum der Argumentation. Hetze gegenüber Migrantisierten, Rassismus und Antisemitismus werden unter diesem Aspekt - zu recht - sehr ausführlich behandelt. Wer die Menschenwürde dieser betroffenen Gruppen systematisch verneint und unterhöhlt, so die Argumentation, verlässt damit den Rahmen des Grundgesetzes und richtet sich aktiv gegen die freiheitliche Grundordnung.Man hätte nun exakt derselben Argumentation folgend auch Aussagen beispielsweise zu queeren Menschen untersuchen können. Insbesondere die Obsession mit trans Menschen und die Hetze gegen das Selbstbestimmungsgesetz hätten sicherlich etliche Anhaltspunkte dafür gegeben, dass auch hier systematisch Menschenwürde, Teilhabe und Gleichbehandlung einer bestimmten Menschengruppe angegriffen werden: Die zahllosen geifernden, beleidigenden Reden der Abgeordneten Storch, Forderungen nach CSD-Verboten und Abschaffung der „Ehe für alle“, Forderungen nach Kriminalisierung der Erwähnung queerer Menschen im Schulunterricht, die Vernetzungen mit anderen anti-queeren Organisationen ("Demo für Alle" usw.) - nichts dazu findet sich im Gutachten.
