When US District #Judge James #Boasberg ruled in April that #Trump admin officials could face #criminal #contempt charges for #deporting migrants in defiance of a #CourtOrder, the blowback was immediate.

Trump’s supporters unleashed a wave of #threats & menacing posts. And they didn’t just target the judge. Some attacked Boasberg’s brother. Others blasted his daughter. Some demanded the #family’s arrest – or #execution.

Drew C. Ensign, a lawyer for the #DOJ, gave his word that no flights were scheduled to depart from the Bluebonnet center on Friday night or Saturday morning, adding that the immigrants there would be given at least 24 hrs’ notice before they were deported.

But Judge #Boasberg was skeptical of Ensign’s assertion, pointing out that the notice forms the #Trump admin had given to the #Venezuelan men did not contain an explicit statement that they were able to challenge their #deportations.

A federal appeals court in Washington put off for the moment a plan by Judge #Boasberg to open #contempt proceedings to determine whether the #Trump admin violated an order he issued last month stopping flights of #Venezuelan immigrants from being sent to #ElSalvador. The United States Court of Appeals for DC said it was entering what is known as an administrative stay to have more time to consider the validity of Judge Boasberg’s proposal.

Vincent Warren, Center for Constitutional Rights, ‘I am concerned the courts will capitulate and that other federal judges will allow the Trump administration to get away with what they’re trying to do. And the other thing that I’m concerned about is, even if the courts don’t capitulate, if they do issue these orders, I’m very concerned that the Trump administration will say, “Yeah, oopsie. We don’t really care.”’

CBS News: Here's what happens if Judge #Boasberg holds #Trump administration in contempt over #ElSalvador #deportations
Boasberg, who said the government "deliberately flouted" his orders, warned if the administration doesn't change course, he could hold hearings, recommend criminal charges and hire a private attorney to prosecute the case if the #DepartmentofJustice refuses.

On Wednesday, United States District Judge James #Boasberg issued an opinion
finding that the Trump administration likely acted in #contempt of court when they refused to abide by one of his rulings relating to the deportation of Venezuelan immigrants last month.

In his order, Boasberg noted that there was probable cause to suggest that the
#willful #disobedience” of his previous rulings amounted to contempt by members of the Trump White House,
which could be viewed as a #criminal action.

In March, Boasberg had ordered the temporary halting of deportations of Venezuelan immigrants the administration had planned to deport
— and indeed, had already begun sending
— to El Salvador. In an addendum oral order, Boasberg also said that the administration must turn around planes that were en route to that country.
The Trump administration #refused to abide by that command,
and in the weeks afterward gave competing rationales for why they didn’t,
initially saying that the oral order meant they didn’t have to follow it,
and later claiming they could ignore Boasberg because the flights were over international waters.
In his Wednesday order, Boasberg stated that
“the Government’s actions on that day demonstrate a willful disregard”
for what he had said should happen.

"It also sets in motion a process that is likely to challenge whether the courts actually retain the ability to constrain the Trump administration — a fundamental question about whether our Constitution’s separation of powers remain functioning.

It is, ultimately, a question about whether the Constitution as we know it remains in effect."

"Chief Judge James Boasberg has found 'probable cause' that the Trump administration should be held in contempt because it 'willfully disobeyed' his Saturday, March 15 orders that the administration not deport people under President Donald Trump’s Alien Enemies Act proclamation while a case challenging the proclamation could proceed."
